Bay Area Truck Accident Lawyer

Massive commercial trucks transport the consumer goods that we all use. These big rigs do get the job done, but when they are involved in accidents, the accidents tend to be extremely dangerous (especially for occupants of the other vehicle involved). If a truck driver’s negligence leaves you injured in an accident, you need an experienced Bay Area truck accident lawyer on your side.

Truck Drivers and Their Responsibilities

The truckers who man the 18-wheelers that roam our highway systems are the primary defense against dangerous truck accidents. Truck drivers know their truck, know how they should ride, know when they aren’t performing safely, and know when pulling off the road is necessary. Further, truckers are responsible for performing regular safety checks and all scheduled maintenance. Finally, truck drivers are professional drivers, and as such, they are guided by more careful rules and regulations, including precise hours-of-service restrictions.

Truck Driver Negligence

Because truck drivers are professional drivers who operate the massive vehicles with which we share our roadways, there is absolutely no wiggle room when it comes to safety. Negligent truck drivers endanger everyone traveling on the roadway with them. Truck Driver negligence can take a variety of forms, including:

  • Distraction – Truck drivers whose attention is diverted by anything other than trucking safely make our roads less safe. One of the most dangerous and most common distractions is the ever-handy smartphone, and truck drivers are not immune to its siren song. Texting is the most dangerous distraction associated with smartphone usage (in a long list of dangerous distractions), and when a truck driver writes or reads a text behind the wheel, he or she might as well be driving blind (which is frightening to even think about).
  • Exhaustion – Truck drivers face strict hours-of-service regulations for a very good reason, and that is that drowsy drivers are dangerous drivers who should not be behind the wheel. Exhaustion can have physical effects that are much like those caused by alcohol, which tells you something about exactly how dangerous drowsy driving is.
  • Impairment – While we’re on the topic, let’s talk about impairment. No driver should ever drink and drive, but when a trucker does it, the danger increases exponentially. The law does not tolerate truck drivers who get behind the wheel after even one drink.
  • Speed – Excess speed plays a significant role in some of the deadliest traffic accidents, and when the vehicle that’s barreling down the highway is an 80,000-pound semi, it ups the ante considerably.
  • Aggression – When you see a truck moving erratically across the road, it’s time to find a way off that road. Aggression has no safe place behind the wheel of any vehicle, but when a truck driver is dangerously aggressive, no one is safe. Aggressive drivers tend to engage in multiple forms of unsafe driving that can include darting in and out of traffic, provoking other motorists verbally and/or physically (with obscene hand gestures and the like), tailgating (having an immense semi on your tail is terrifying), incessant honking, ignoring the rules of the road, and much more.
