What to Do if Hurt in a Rideshare Accident

February 20, 2022
SHARE POST:

Rideshare companies like Uber and Lyft have certainly made getting around far easier. It’s difficult to imagine anything more convenient than simply harkening a ride on an app, but Uber and the others made it happen. Rideshare accidents, however, come with their own complications. If a rideshare driver’s negligence leaves you injured in an accident, don’t delay consulting with an experienced California rideshare accident attorney.

First Things First

The first order of business after being injured in any kind of accident is seeking the medical help that you need. It’s important to point out that, even if you don’t think you were seriously injured in the rideshare accident, such injuries can be slow to present with identifiable symptoms. In other words, seeing a doctor after being injured in a car accident is always a good idea. Additionally, carefully following your doctor’s instructions and advice is the right thing to do for your health and for your rideshare accident claim.

Your Rideshare Claim and Insurance Coverage

The primary additional complication of rideshare accidents is deciphering which insurance provider is responsible, and the answer may surprise you. Consider the following:

  • If your rideshare driver is on the rideshare app at the time of the accident and has a passenger in his or her vehicle, the rideshare company’s own coverage will handle the claim. For example, Uber’s insurance provides considerable coverage under these circumstances. The same coverage applies if the driver is en route to pick up a rideshare passenger.
  • If your rideshare driver is on the rideshare app at the time of the accident but is merely waiting for a request to pick up a passenger, the driver’s own coverage handles the claim, and the rideshare company’s insurance kicks in where the driver’s coverage ends.
  • If the rideshare driver is no longer on the rideshare app, he or she is officially outside the rideshare company’s insurance coverage, and the claim proceeds in the same way it would for any other car accident (through the at-fault driver’s own coverage).

Your Rideshare Accident Claim

Once you’ve established which insurance company is responsible for handling your claim, it’s important to recognize that because the insurance company is driven by profits, it is going to do what it can to minimize your settlement. In response, there are several points to keep in mind (in relation to protecting your claim):

  • Follow your doctor’s orders carefully.
  • Work closely with an experienced rideshare attorney.
  • Allow your rideshare attorney to handle the insurance company on your behalf (the less you yourself communicate with the insurance company, the better)
  • Give social media a pass (the insurance company is on the lookout for statements and/or photos that it can manipulate to tarnish the integrity of your claim)
